Public Health Amendment (No.2) Act

Simplified for You

What this bill does

This bill gives the Health Minister new powers to declare a public health emergency when there's a serious disease threat in Bermuda. During these emergencies, the government can make special rules that override normal laws (except the Constitution) to control the spread of disease.

If passed (voted YES)

  • The Health Minister can declare 30-day public health emergencies (extendable to 60 days) when consulting with the Chief Medical Officer about serious disease threats
  • During emergencies, the government can impose restrictions like requiring people to stay home, limiting where people can go, and mandating health protection measures
  • These emergency rules can override other Bermuda laws, including the Human Rights Act, as long as they don't conflict with the Constitution

If rejected (voted NO)

  • The government keeps only its current powers under existing health laws to respond to disease outbreaks
  • No new legal authority to declare formal public health emergencies or create special emergency regulations
  • Current laws and rights protections remain fully in effect with no provisions for emergency overrides

Who it affects

This affects all Bermuda residents, as the emergency powers can restrict people's movements and activities during health crises. The bill specifically mentions it can override human rights protections when public health emergencies are declared.
