Trust (Special Provisions) Amendment Act
What this bill does
This bill updates Bermuda's trust laws to make it clearer when Bermuda courts can handle trust disputes and to strengthen protections for trusts governed by Bermuda law. It creates better "firewall" rules that prevent foreign countries' laws and court orders from interfering with Bermuda trusts, especially in cases involving inheritance, divorce, or bankruptcy claims.
If passed (voted YES)
- Bermuda courts will have clearer authority to handle disputes about trusts that have connections to Bermuda, even if some parties live overseas
- Trusts governed by Bermuda law will be better protected from foreign inheritance laws, divorce settlements, and bankruptcy claims trying to access trust assets
- Foreign court orders that conflict with Bermuda trust protections cannot be enforced in Bermuda
If rejected (voted NO)
- The current trust laws remain in place, which are described as "unclear and confusing" in their firewall protections
- Bermuda may be less competitive as a jurisdiction for international trust business compared to other offshore financial centers
- There could be continued uncertainty about when Bermuda courts can handle trust disputes involving foreign elements
Who it affects
This primarily affects wealthy individuals and families who use Bermuda trusts for estate planning, asset protection, and international business purposes. It also impacts trust companies, lawyers, and other financial services professionals working in Bermuda's trust industry.
